Terms of use

This is an English translation. In case of discrepancies, the Italian version prevails.

1. Who we are

XO Kings is developed and operated by Giacomo Bibbiani, Piombino (LI), Italy ("we"). Contact: supporto@xokings.com.

2. The service

• XO Kings is a free card game for iPhone and Android, with matches against the computer (also offline) and online features: friends and friends chat, asynchronous challenges, Normal and Ranked matches, 2 vs 2, Brawl, Arena, Duel, the Tavern of Kings, Adventure, Conquest, seasons, pass, mail, gift codes and community ideas.
• Online features require an internet connection and our server. We may update, change or temporarily suspend the service, for example for maintenance, card balancing or new seasons.
• If we ever shut the game down, we will announce it at least 30 days in advance in the game and on this website.

3. Account

• On first launch the game creates a guest account tied to your phone. You can link it to Apple or Google: without that link, your account may be lost if you uninstall the app or change phone.
• You are responsible for what happens on your account. The account is personal: don't sell it, give it away or use someone else's.
• Your player name must not be offensive, vulgar, discriminatory, misleading (e.g. pretending to be staff) or infringe the rights of others. We may change a name that breaks these rules.
• If you are under 14 (or the age set by the law of your country), you may use the game only with the permission of a parent or guardian.

4. Rules of conduct

To keep competition fair, you may not:

• use cheats, bots, third-party software, modified versions of the app or bugs to gain an advantage;
• collude with others to fix matches or leaderboards, or create multiple accounts for that purpose;
• decompile, copy or attack the app, the server or their APIs, or overload them;
• harass or deceive other players, including in chat, or use the game for illegal activities;
• post offensive content, advertising, other people's personal data or links to illegal content in messages or ideas. Approved ideas may be published on this website's Ideas board, without your name.

If you find a bug, please report it: we'll be grateful. In case of violations we may, in proportion to their seriousness, cancel unfairly obtained rewards, exclude you from Ranked, suspend or close the account. Before a permanent closure, except in serious or urgent cases, we will notify you and you can give us your side of the story.

5. Virtual items

• Cards, coins, Ink, packs, levels, cosmetics and rewards are digital content of the game: we grant you a personal, limited and revocable licence to use them in XO Kings. You don't own them, they have no monetary value, and they can't be exchanged for money, transferred or sold outside the game.
• Packs can only be opened with coins earned by playing and are never sold for real money. The odds for each rarity are shown in the game.
• To keep the game balanced we may change the cost, power or abilities of cards and the rules of game modes.

6. Purchases (in the future)

• In the future, only non-random items may be sold through the App Store and Google Play: for example the season's premium pass, cosmetics or Ink. Before buying you will always know exactly what you get.
• Payment, billing, subscription renewals, cancellations and refunds are handled by Apple or Google under their terms. A subscription is cancelled from your Apple or Google account settings.
• Digital content is delivered immediately after purchase. Therefore, under EU consumer law (in Italy, Art. 59(1)(o) of the Consumer Code), by requesting immediate delivery and acknowledging the loss of the right of withdrawal, that right no longer applies once you receive the content. Your rights in case of faulty or undelivered content remain: if something doesn't arrive, write to us.

7. Intellectual property

The game, the XO Kings name, rules, code, artwork, text, music and graphics belong to Giacomo Bibbiani or their respective owners and are protected by law. You may take screenshots and videos of your matches and share them, including on monetised channels, as long as you don't suggest they are official content.

8. Liability

We do our best to make the game work well, but we can't guarantee it will always be available or free of errors. To the extent permitted by law, we are not liable for the loss of virtual items due to causes beyond our control, to an account not linked to Apple or Google, or to breaches of these terms. This limitation does not apply in case of wilful misconduct or gross negligence, personal injury, or the rights granted to consumers by law.

9. Deleting your account

You can stop using the game and ask for your account to be deleted at any time: instructions are on the Support page. Deletion is permanent: progress and virtual items are lost, including purchased ones, except as provided by law.

10. Changes to these terms

We may update these terms, for example for new features or changes in the law. Important changes will be announced in the game before they take effect; if you don't accept them, you can stop using the game and ask for your account to be deleted.

11. Governing law and disputes

These terms are governed by Italian law. If you are a consumer, the courts of your place of residence have jurisdiction and the mandatory consumer protection rules of your EU country of residence still apply. Before taking legal action, please write to us: we'll try to solve the problem together.
